Terms & Conditions

  • All bidders must register. The auction program will accept bids ONLY from registered bidders.
  • No horse will be sold for under $1000.
  • Each horse will be sold to the highest bidder as determined by the auction program, which is final.
  • The sale staff and the Canadian Warmblood Horse Breeders Association (CWHBA) act as agents for the seller but assume no responsibility for the buyer or the seller.
  • The sales committee reserves the right to reject any or all bids.
  • All horses sold must pass the basic pre purchase exam for foals as outlined in the settlement of sale.
  • All horses sold as is. Right of recourse must be directed to the seller and not to CWHBA or sale management.
  • All horses sold must be delivered, complete with halter, to the new owner.
  • A sale by auction is complete at the published date and time of the individual lot closing.
  • Upon settlement of sale (see below), all risk, title, care and responsibility shall pass to the buyer.
  • The right to bid is reserved expressly by and on behalf of the seller or any one person assigned by the seller as an agent.
  • CWHBA management, employees, auction staff and volunteers accept no responsibility or liability for injury or damage to persons, horses, or equipment, as a result of participating in the auction.
  • Every effort has been made to ensure correctness of sale website, however, sale management assume no responsibility for errors or omissions..
  • Terms of sale will be determined and agreed upon between the buyer and the seller
  • GST may be charged on horses sold, according to Canadian Law.
  • Sale management will withhold registration papers until settlement of the sale is complete, at which time, all documents will be processed for transfer to the buyer. The seller will pay all transfer fees, according to Canadian Law.
  • Should the buyer fail, in any respect, to comply with all conditions above, the Sale Management may, at its discretion, pursue any remedy available against the defaulting buyer, including but not limited to, charging a minimum $1,000 to the credit card provided, taking possession of the horse(s) and resale of the horse(s) at public auction or by private treaty for account of the defaulter. In such a case, the defaulter shall be liable for any deficit in the account after payment of all costs of maintenance and resale, attorney fees, costs of litigation, and damages available to seller by law.
